No-one can order you to arrest anyone. If YOU don't believe there are reasonable grounds to suspect or YOU don't feel the arrest is necessary (SOCAP rules) then YOU have the discretion to deal with the matter in other ways. Anyone who orders you to make an arrest should be politely reminded of their own constabulary powers and left to get on with it.

No you didn't - see above!

It is NOT a lawful order for a supervisor to order you to make an arrest, so don't worry about the discipline issue. You should be reporting these incidents to the Federation, so they can remind the management about police powers.



This is my turn to agree with you, 5Js. The only time that you must arrest is under the Vagrancy Act 1824, what is left of it. At all other times it is down to the officer dealing to decide what action to take.

If a senior officer tells you to arrest and deal with the arrested person, it is an unlawful order. The senior officer can, of course direct you to arrest the person on his/her behalf. That senior officer will then have to attend the custody suite and deal as the arresting officer.

If you really want to stir the mire, the next time a senior officer directs you to arrest someone take the person to custody and tell the custody Sergeant "I have arrested this person for xxxxxx and he/she will give you the evidence for the arrest". Then stand by for incoming.

I was ordered to arrest a deaf and dumb man at 11pm for a minor assault (he obviouslt stayed in all night as we needed a signer for interview etc), and on the way back to the nick i had to arrest a 65 year old lady for a neighbour dispute (harrasment). She refused to get dressed so she came in her slippers and dressing gown. I finished my shift feeling great, like i'd really made a difference!!

A big part of the problem is the divisional commanders and all of his underlings are spineless. Mr Baker has a 'Do it or i'll find someone else to do it' attitude and those below him are so intent on self promotion they carry out his crappy orders without question. And then, as usual, it rolls downhill!

 

It is that bad. Morale is dreadful.



Essexvic - You misunderstand my post mate, I was not saying PLOD was lying. My comment was in relation to the comments about manipulated stats and the false impression they give the public.I was saying infact,that in a way our organisation is lying to the public.

I am an Essex detective.......... I am experiencing the same frustrations as you and PLOD.

 Your post was not ambiguous and i didn't think you were implying that Plod was lying, i just think that sometimes people reading the posts may think we exaggerate how bad it really is!!

5J's and Penb, thanks for pointing that out. i was aware of this but have gone past the stage of stirring things up - it never does you any good! After a good few years of always doing and saying what i believe was morally right, and getting absolutey nowhere(except into heated arguments with those outranking me) i'm at the stage now where i will do as i'm told (to a point) and go home as soon as i can!

In response to the responses my original post made I can state the following:

With our current workforce size, no the policices are clearly not working. It is patently obvious to everyone they are not, hence the morale being at all time low levels. Re Rog being in charge of amalgamated force, I belive that wont happen as HMI has said that Chiefs will not be able to head a force that contains their old one. Therefore, many hoping merger takes place.

Re SOCPA, I would suggest there are many cases where arrests are borderline re compliance wiht SOCPA, ie some being made that could be dealt with by other means. (FPN's or good old fashioned advice).

We have had teams pulled from front line duties to pick up old arrests on jobs that are clearly not going anywhere, whilst we have not got anyone to react when info re a burglary about to happen comes in. The intial pride has really gone, but still at least Rog will get a visit to the queen for a medal at some point.

It seems no mergers are going ahead at all now, apparently its too expensive, considering one of the reasons was to save money that seems a bit strange. Then again maybe it would have been too politically expensive, I heard up to 25,000 jobs would have gone

So far I see a lot of criticism of Mr Baker, but it is interesting to note, that he was not at all for amalgamation, his reasons were sound and valid. Likewise I do not believe you can blame one man for the way Essex is going at the moment. I agreee Morale is at an all time low, but so it is countrywide from colleagues I meet.

If we are to blame, (as this seems to be the culture), then go for the very top, go for government. They are the ones who demand results and dangle carrots for those below to strive for. You cannot blame one man for striving for that carrot as in his shoes, you may well do the same.

I do not agree with some of his policies by any means, arrests for arrests sake are not on and possibly as mentioned against the new rules. But I am sure, if the pressure from above was lowered and chiefs were able to have the full reigns again, then more sensible and I daresay more efficient policing would ensue as opposed to the statistic creating policing we are doing at the moment.

You cannot measure performance with made up statistics.

Just ask any statistician.........I did and 90% of them agree they are not reliable, 5 % were not sure, 4% said they could prove they existed and 2% did not have a Maths 'o' level between them.

All bosses are figures orientated, especially ' sanctioned detections ' whose bright idea was that?? disqual driving - a good proactive collar- no SD,      shooting fish!?!? - SD. I kid you not!!

During public order fri/sat nights etc.. I mainly arrested for drunk and disorderly as did most of my colleagues. Now, because thats not an SD, we are told to arrest S5 which is an SD ( oh by the way, the bosses then slate us because crime is going up )

I don't know much/anything about Essex Police but I bet every officer on this forum can give similar examples relating to their ch cons.

Hmm,

The whole detections thing is deeply iffy if you ask me. I have sat in on town centre fri/sat night briefings to be told how the management will not be happy for d and d arrests, and to arrest s5 instead. AS 5jays says, I will be arresting people IF I feel it is appropriate and for the offence I feel they are committing...

And luckily the bright spark who started telling us to issue £80 S5 FPN's for weeing in the street was shown the error of their ways...

Not being funny but pissing in the street is an anti social act and people quite rightly should be given a fine for their efforts if it is in public... It smells for days after too and gives the impression that some places just aren't that safe.

I have always given tickets out for it, and I still do as a sergeant.. long before anyone ever issued an edict... It takes ten minutes of my time up hardly a hardship (and its a clear up )

Yes, I agree it's antisocial and people should be dealt with for it, but surely s5 is inappropriate? Can you issue a £50 FPN for the actual offence of urinating in public then?

Perhaps Mr Baker should read John Stevens book "Not For The Faint Hearted - My Life Fighting Crime" and learn some man management skills I'm sure he has some great ideas (but then so does my 10 year old son) - after all he's not playing with an oversized train set these are real issues

The rumour was that someone abused the internet access and managed to accrue 40 hours internet time in a 39 hour week (lazy git)- if they cannot deal with an individual who abused the system in this way then we all have to suffer losing an important investigative tool well done once again

As for meeting him be careful as you have now made comments against him - maybe a panorama style interview where you are in the shadows

Every 'Master / servant' relationship should be built on mutual respect and trust. What Mr.Baker has done and is continuing to do has seriously damaged that respect and led to accute distrust.

Staff who believe  that they cannot be trusted to use the internet  or even receive an email from a frend, relative or colleague from outside the force, let alone dare to send one on an 'email free day' wll not be inclined to give their best to the service.

Bringing back motorcycles and horses is all very well (they should never have been removed in the first place !) but  this will all be to no avail unless Police officers and support staff are treated like responsible adults.

Of course Mr.Baker has to 'make his mark' and obviously there is room for improvement but running at it like a 'bull in a China shop' is not the way. A good leader will listen to his troops as well as commanding them and will first and foremost, make it clear to the rank and file that they are the most important ingredient in this mix. Lose Mr.Baker and he can be replaced, lose the will of the officers and staff and the good (and bad) people of Essex will be doomed.

A bit of foot shooting in Essex. A funeral cortege en route to the Crem, 25 vehicles, first 17 get through lights on green, last eight get FPN for jumping a red light. All other traffic did stop to allow cortege through.  Can't see Rog letting them off as it will effect his figures to impress the H.O.Dead

Does the management feel that there is something wrong with control room staff accessing this site at, say, 4 in the morning ? We sit there, tethered by an electrical umbilicus to a desk, in temparatures that are so low we are still having to wear sweaters at work (these don't keep your hands and legs warm though), and are expected to be at a constant state of vigilance at all hours, without recourse to this useful stimulant for the brain.

I have long felt that it is more useful to be looking at your monitors than reading a book during these quiet times. Your eyes and brain are in gear and ready to deal with the next important job.

This is weak, blanket management of the worst type. It is not new to this chief though. Some time ago, each divisional controller had his own dedicated back-up to make calls for him/her, and to type a commentary on fast running incidents in order that the dispatcher could concentrate on running the incident. In quiet times the back-up was expected to take phone calls. Some back-ups were not taking calls, so, instead of dealing with those individuals, we ended up with shared back-ups so that the organisation would have more call takers. The back-ups that were not taking calls were in the wrong, but so was the way in which the management dealt with the issue.

The morale in the control room is now so low that 44 people have applied for a job that was advertised on our intranet. The management should be asking 'what is so wrong that this number of people want to get out?' Are they asking this question ? I doubt it

Well there certainly appears to be a lot of unrest and low morale in Essex Police at the moment. A lot of experienced officers are going to the Met and many civilian staff are applying for jobs elsewhere. These are mainly people who have many years service and are irreplaceable. Staff, from what i hear, are fed up with being treated like children, whilst senior officers appear to be running scared, with the be all and end all on the detection rate reaching a certain level at all costs, but i wonder at what cost it will be to the force if it affects so many staff morale wise or health wise, seeing as the sick record has doubled in a year ?

as we know good ole rog has the nark about this and has blocked the site to essex officers (even the officers WITH internet access) - that tells a story........

I reckon most are too apprehensive to make a comment on here and i don't really blame them but I reckon he's just a bully we all know his methods after all and so far only 1 person has tried to stick up for him (by his own admission a friend and therefore probably an acpo rank)

Freedom of speech! - Come on be heard after all we can't do much else about him for the moment.........

He'd make a great duo with the welsh chief ridiculed by The Sun yesterday if you ask me

He obviously has never done a man management course, and sees himself as the 'saving sole of Essex'',  I suggest he goes for a very long ride on one of his horses, and doesn't come back.
